Terms and Conditions of Service

Please read these Terms and Conditions ("Terms") carefully before using any services offered by HighAchieversOnly ("we," "us," or "our"). By accessing our website, scheduling a session, enrolling in a subscription, or engaging any of our services, you ("Client") agree to be bound by these Terms in their entirety. If you do not agree, please do not use our services.

HighAchieversOnly is a human-operated business founded and managed by a qualified professional with advanced education, training, and experience. It is our firm commitment that all clients and providers within our system are treated with the dignity, respect, and professionalism commensurate with that standard.

1. Services Offered

HighAchieversOnly provides a range of educational, consulting, and professional development services, including but not limited to:

Academic tutoring (all grade levels through graduate school)
Digital and web consulting
Coaching and mentorship
Teaching and instruction
Curriculum design and development
Other related consulting and educational services

Details about specific additional or specialized services not listed above may be requested by contacting the founder and owner directly via the official business email address. Service availability, scope, and pricing are subject to change and will be confirmed in writing prior to engagement.

2. Nature of Services — Human Provider Standard

All services provided through HighAchieversOnly are performed by a human professional with verified advanced education and relevant qualifications. Clients are entitled to expect, and will receive, a high standard of professional conduct, subject-matter expertise, and personalized attention. In turn, clients are expected to engage with the same standard of mutual respect and professionalism. HighAchieversOnly reserves the right to discontinue services with any client who engages in conduct that is disrespectful, abusive, or otherwise inconsistent with a professional service relationship. In such an event, no refund will be given unless deemed appropriate by the founder based on services rendered.

3. Payment Terms

3.1 Individual / One-Time Sessions

Payment for individual sessions or one-time services is due as specified at the time of booking. Accepted payment methods will be communicated during the scheduling or onboarding process. Failure to remit payment in a timely manner may result in suspension or cancellation of scheduled services.

3.2 Subscription Plans

HighAchieversOnly offers recurring subscription plans that provide ongoing access to specified services on a monthly billing cycle. By enrolling in a subscription, you authorize recurring charges at the then-current subscription rate. Subscription fees are billed at the start of each billing period and are non-refundable except as described in Section 4 below.

4. Refund and Cancellation Policy

4.1 Individual Services

Refund requests for individual or one-time services are evaluated on a case-by-case basis. Eligibility for a refund will be determined by examining all relevant digital records, session data, and correspondence between the client and HighAchieversOnly. The extent of services rendered at the time of the refund request will be the primary factor in any determination. Refunds, if granted, will be prorated or adjusted to reflect services already delivered or time already consumed. To initiate a refund request, clients must contact the owner directly via email with a written explanation of their request.

4.2 Subscriptions

Subscription fees are non-refundable. However, clients may cancel their subscription at any time, and cancellation will take effect at the end of the current billing period. Upon cancellation, clients retain reasonable access to services for the remainder of the paid period. The scope of "reasonable access" during this wind-down period is determined on a case-by-case basis at the discretion of HighAchieversOnly, taking into account services already utilized during the billing cycle.

To cancel a subscription, clients must notify HighAchieversOnly in writing via email prior to the next billing date. Cancellations requested after a billing date has processed will apply to the following billing period.

5. Services Involving Minors

HighAchieversOnly takes the safety, welfare, and legal protection of minors very seriously. The following requirements apply without exception to any client who is, or who is seeking services on behalf of, a minor (any individual under the age of 18):

A parent or legal guardian must provide documented written consent prior to the commencement of any services involving a minor.
The consenting parent or guardian must remain actively involved in the service relationship to the extent required by applicable law and as reasonably requested by HighAchieversOnly.
All consent processes and service arrangements involving minors must comply fully with the laws and regulations of the state of Tennessee and, where applicable, the laws of the minor's state of residence.
HighAchieversOnly reserves the right to request verification of parental or guardian status and to require additional documentation as deemed appropriate.
Services will not be rendered to a minor in the absence of verified parental or guardian consent. Any misrepresentation of a client's age or legal status may result in immediate termination of services and/or legal action to protect the child.
All active tutors are required to submit to background verification. If any questionable or inappropriate behavior is ever detected or suspected, HighAchieversOnly takes these allegations very seriously. Please inform the founder directly at the earliest, safest, convenience.
HighAchieversOnly will cooperate in legal action to protect children and hold their abusers accountable to the fullest extent of the law without exception.

6. Client Confidentiality and Data Privacy

HighAchieversOnly treats all client information with the highest standard of confidentiality. Specifically:

All personally identifiable information, session records, communications, and client data collected in connection with our services are strictly confidential.
Client information will never be sold, leased, licensed, disclosed, or transferred to any third party for any purpose, commercial or otherwise.
All client data is treated with the same level of care and protection as Protected Health Information (PHI) under applicable privacy principles, to the fullest extent possible given the nature of our services. While HighAchieversOnly is not a covered entity under HIPAA, we voluntarily adopt equivalent data protection standards as a matter of professional ethics.
The founder of HighAchieversOnly [Sarah E. McKinzie] is PHRP (Protecting Human Research Participant) and HIPAA certified within the bounds of her career and past, and will continue to act professionally in accordance with all such regulations as required by aw and expected by ethical standards.
Digital correspondence, session notes, assessment materials, and any other client-related records are maintained securely and accessed only on a need-to-know basis within our organization.
In the event that disclosure of client information is required by law, court order, or valid legal process, HighAchieversOnly will notify the client to the extent permitted by law prior to any such disclosure.

Clients who have concerns about the handling of their information are encouraged to contact us directly in writing.

7. Intellectual Property

All original content, curricula, instructional materials, written resources, and other works created by HighAchieversOnly and provided to clients in connection with services remain the intellectual property of HighAchieversOnly. Clients are granted a limited, non-exclusive, non-transferable license to use such materials solely for their individual personal educational use. Reproduction, redistribution, resale, or modification of any HighAchieversOnly materials without express written consent is strictly prohibited.

8. Disclaimers and Limitation of Liability

HighAchieversOnly provides educational, tutoring, and consulting services in good faith and in accordance with the professional qualifications of its provider. However:

We do not guarantee specific academic outcomes, test scores, grade improvements, or professional results. Individual results will vary based on the effort, engagement, and circumstances of each client.
HighAchieversOnly is not liable for any indirect, incidental, consequential, or punitive damages arising from the use of, or inability to use, our services.
Our total liability to any client for any claim arising from our services shall not exceed the total amount paid by that client in the three (3) months immediately preceding the claim.

9. Modifications to These Terms

HighAchieversOnly reserves the right to update or modify these Terms at any time. When changes are made, the updated Terms will be posted on our website with a revised effective date. Continued use of our services following the posting of updated Terms constitutes your acceptance of those changes. It is the responsibility of clients to review these Terms periodically. For material changes, we will make reasonable efforts to notify active clients via email.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall first be addressed through good-faith communication between the parties. If a resolution cannot be reached informally, the parties agree to submit to the exclusive jurisdiction of the courts located in the State of Tennessee or the founder’s state of residence at the time of the legal event.
